Proton follows EU privacy rules. All your data is stored encrypted on servers in Switzerland, Germany, and Norway. Even Proton's own team can't read your emails. The company offers a data processing agreement for businesses. Under Swiss law, Proton can be required to hand over metadata like IP addresses and account creation dates when courts order it. This has happened in cases involving activists. Your email content stays encrypted and unreadable, but metadata isn't protected by encryption.
