Acceptance of Terms
By accessing and using Switch-to.eu and any of its tools (including KeepFocus, Plotty, Listy, Privnote, Quiz, and Kanban), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These Terms should be read together with our Privacy Policy, which explains how we process your personal data.
Our services are intended for users aged 16 or older. By using our services, you represent that you meet this age requirement.
Description of Services
Switch-to.eu provides:
- Information and guides to help users switch from non-EU digital services to EU alternatives
- A directory of EU-based service alternatives
- Free online tools including productivity, collaboration, and privacy-focused utilities
All services and tools are provided free of charge and designed with privacy in mind. To sustain our services, we may display advertisements or sponsored content. Any advertising on our platform will be privacy-friendly and will not involve tracking your activity across websites or building a personal profile about you. Sponsored content will always be clearly labelled as such.
Because our services are free, we operate them on a best-effort basis. We may modify, suspend, or discontinue any part of the services at any time, with or without notice, and without liability to you.
User Responsibilities
When using our services, you agree to:
- Use the services only for lawful purposes
- Not attempt to disrupt, overload, or interfere with the operation of our services
- Not attempt to gain unauthorized access to any part of our systems
- Not use automated means (bots, scrapers) to access our services in a way that degrades the experience for others
- Not upload or share content that is illegal, harmful, or infringes on the rights of others
Tool-Specific Terms
Temporary Content Tools (Plotty, Listy, Privnote, Quiz, Kanban)
These tools create temporary, user-generated content stored on our servers:
- No guarantee of availability: Content is stored temporarily and may expire or be deleted at any time without notice. We do not guarantee long-term storage or availability. You should not rely on these tools as your only copy of any important information.
- End-to-end encryption: Where applicable, content is encrypted in your browser before being sent to our servers. We cannot access or recover encrypted content if you lose the encryption key (contained in the URL fragment).
- Expiration: Content is subject to automatic expiration based on the tool's settings or default time limits. Typical expiration ranges from 5 minutes to 30 days, depending on the tool and your chosen settings.
- No backups: We do not create backups of user-generated content in these tools. You are responsible for saving any content you wish to keep.
- Public links: Anyone with the link to your content can access it. Keep links private if you do not want others to access your content.
Some tools (such as KeepFocus) store all data locally in your browser and do not transmit any data to our servers. We are not responsible for loss of locally stored data due to browser data clearing.
Infrastructure and Hosting
All Switch-to.eu websites and tools are hosted on Vercel. Our serverless functions are configured to execute in the European Union (Frankfurt, Germany — fra1 region). Our Redis database, used by tools such as Plotty, Listy, Privnote, Quiz, and Kanban, is hosted by Vercel in the same EU region.
Vercel is a US-based company that operates on AWS, Azure, and GCP infrastructure. While we configure EU execution for our functions and database, certain processing (such as builds and deployment pipelines) occurs in the United States. Vercel is certified under the EU-US Data Privacy Framework and provides Standard Contractual Clauses for data transfers. For more details, see the International Data Transfers section of our Privacy Policy.
Intellectual Property
- The Switch-to.eu website, its design, and original content are owned by the operators listed above
- Migration guides and service information are provided for informational purposes
- User-generated content (polls, lists, notes) remains the property of the users who created it. By creating content using our tools, you grant Switch-to.eu a limited, non-exclusive license to store, process, and transmit that content solely for the purpose of providing the services. This license terminates when the content is deleted or expires.

Data Processing Roles
When you use our tools to create content (such as polls, lists, notes, or quizzes), Switch-to.eu acts as a data processor on your behalf. You, as the creator, are the data controller for any personal data contained in that content.
This means:
- We process the content you create solely to provide and operate the tools as described in these Terms
- We do not access, use, or share user-generated content for any purpose other than delivering the service, except where required by law
- Where content is end-to-end encrypted, we are technically unable to access the content and act only as a storage and transmission provider
- Content is automatically deleted according to the expiration settings of each tool. We do not retain user-generated content beyond its expiration period
- We do not use user-generated content to train models, build profiles, or derive analytics

If you use our tools in a way that involves processing personal data of other individuals (for example, collecting names in a shared list), you are responsible for ensuring you have the appropriate legal basis to do so under applicable data protection law, including the General Data Protection Regulation (GDPR).
Content Moderation and Illegal Content
In accordance with the Digital Services Act (Regulation (EU) 2022/2065), we provide the following information about content moderation on our platform:
Reporting Illegal Content
If you become aware of illegal content hosted on our platform (including content created through our tools), you can report it by contacting us at hi@switch-to.eu. Please include:
- A description of the content you believe is illegal
- The URL or link where the content is accessible
- An explanation of why you consider the content to be illegal
- Your contact information
How We Handle Reports
Upon receiving a report, we will:
- Acknowledge receipt of your report
- Review the reported content in a timely manner
- Take appropriate action, which may include removing the content or disabling access to it
- Inform you of our decision and the reasons for it
Content Moderation Practices
We do not proactively monitor or filter user-generated content. Due to end-to-end encryption, we are unable to access the contents of encrypted data stored through our tools. Our content moderation is limited to acting on reports we receive and removing content that has expired under the tool's settings.
Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the extent permitted by applicable law, including Belgian and EU consumer protection regulations, we disclaim all warranties. We do not warrant that:
- The services will be uninterrupted, timely, or error-free
- The services will continue to be available in their current form or at all
- The information provided about third-party services is accurate or up-to-date
- The tools will meet your specific requirements
- Any content created with our tools will be preserved
Nothing in these terms affects your statutory rights as a consumer under applicable Belgian or EU law.
Limitation of Liability
To the maximum extent permitted by Belgian and EU law:
(a) We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services, including but not limited to:
- Loss of data or content
- Inability to access the services
- Reliance on information provided on the website
- Actions taken based on our migration guides or service recommendations
(b) Given that our services are provided free of charge, our total aggregate liability for any direct damages shall not exceed EUR 100.
(c) Nothing in these terms limits our liability for: (i) death or personal injury caused by our negligence, (ii) fraud or intentional misconduct (opzettelijke fout), or (iii) any other liability that cannot be excluded or limited under applicable Belgian or EU law.
Suspension and Termination
We reserve the right to suspend or restrict access to our services if we reasonably believe you have violated these Terms. Where possible, we will provide notice before taking action.
Content associated with suspended or terminated access may be deleted in accordance with the tool's standard expiration settings. Given the temporary and encrypted nature of content created through our tools, we are generally unable to return content upon termination.
You may stop using our services at any time without notice.
Third-Party Services
Our website contains links to and information about third-party services. We are not responsible for:
- The accuracy of information about third-party services
- The availability or quality of third-party services
- The privacy practices or terms of third-party services
We recommend reviewing the terms and privacy policies of any service before using it.
Modifications to Terms
We may update these Terms of Service from time to time. When we do, we will:
- Update the "Last Updated" date at the top of this page
- Notify users of significant changes through our website
- Continue to make previous versions available upon request
Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.
Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with the laws of Belgium and applicable European Union regulations.
Any disputes arising from these terms shall be subject to the jurisdiction of the courts of Antwerp, Belgium. If you are a consumer residing in the European Economic Area, you may also bring proceedings in the courts of your country of residence, in accordance with Regulation (EU) No 1215/2012.
You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/odr.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
